HomeMy WebLinkAbout89-070 - Resolutions RESOLUTION NO. 89-070 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING ENVIRONMENTAL ASSESSMENT A/~D FOOTHILL BOULEVARD SPECIFIC PLAN AMENDMENT 89-01, REQUESTING TO MODIFY THE REGIONAL RELATED COM}{ERCIALLAND USE OPTION FROM APN: 229-021-59 AND 229-031-15, AND SHOW ACCESS POINTS FOR THE BLOCK BOUNDED BY FOOTHILL BOULEVARD ON THE NORTH, ARROW ROUTE ON THE SOUTH, 1-15 FREEWAY ON THE WEST, AND ETIWANDA AVENUE ON THE EAST, NECESSITATED BY A PROPOSED MWD POWER GENERATING PLANT AT THE NORTHWEST CORNER OF ETIWANDA AVENUE AND ARROW ROUTE IN RANCHO CUCAMONGA, CALIFORNIA The City Council of the City of Rancho Cucamonga does hereby resolve as follows: A. Recitals. (i) The City of Rancho Cucamonga has filed an application for Foothill Boulevard Specific Plan Amendment No. 89-01 as described in the title of this Resolution. Hereinafter in this Resolution, the subject Foothill Boulevard Specific Plan Amendment is referred to as "the application". (ii) On 25th of January, 1989, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application; and (iii) On the 15th of February, 1989, the City Council of the City of Rancho Cucamonga conducted a duly noticed public hearing, concluded said hearing on that date; and heard and considered the Planning commission recommendation of approval; and (iv) All legal prerequisites to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does hereby find, determine and resolve as follows: 1. This Council hereby specifically finds that all of the facts set forth in the Recitals, Part "A", of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Council during the above-referenced public hearings including written and oral staff reports, this Council hereby specifically finds as follows: (a) The proposed MWDpower generating plant at the northwest corner of Arrow Route and Etiwanda Avenue necessitates modification of the access provided the light industrial parcels on the southerly part of subarea 4 of the Foothill Boulevard Specific Plan. Since these parcels also contain Resolution No. 89-070 Page 2 a land use option to develop as regional related commercial, access options are proposed which are dependent on which land use develops, as shown on the attached Exhibits A and E. (b) The property to the north of the subject site is designated Regional Related Commercial usage. The property to the west is designated 1-15 Freeway. The property to the east is designated community commercial and residential. The property to the south is designated General Industrial; and (c) The application does not conflict with the Circulation policies of the General Plan and will provide for development in a manner consistent with the policies and goals of the General Plan and with related development; and (d) The application promotes the policies and goals of the Foothill Boulevard Specific Plan. 3. Based upon the substantial evidence presented to this Council during the above-referenced public hearings and upon the specific findings of facts set forth in paragraphs 1 and 2 above, this Council hereby finds and concludes as follows: (a) The application does not conflict with the Circulation policies of the Foothill Boulevard Specific Plan; and (b) The application promotes the goals of the Foothill Boulevard Specific Plan. 4. This Council hereby finds and certifies that the application has been reviewed and considered in compliance with the california Environmental Quality Act of 1970 and adopts a Negative Declaration. 5. Based upon the findings and conclusions set forth in paragraphs 1, 2, 3, and 4 above, the City Council of the City of Rancho Cucamonga, California, on the 15th day of February, 1989, hereby approves Foothill Boulevard Specific Plan Amendment 89-01. 6. BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed to advertise as required by law. PASSED, APPROVED, and ADOPTED this 1st day of March, 1989.
