HomeMy WebLinkAbout86-282 - ResolutionsRESOLUTICtq NO, 86-282 A RESOLUTICtQ OF TNK CITY COUNCIL OF TEN CITY OF RAHCHO CUCAM(IqGA; CALIFOIBIA ESTABLISHIXG POLICIES FOR THK PRESERVATIG8 AND IMPROVEMENT OF KTIWAHDA AVSHUg STORE CURBIIqG NORTH OF FOOTHILL BOULBVAia) WBERFA8, the City Council of the tit7 of ltancho Cucasonga, California recognizes the stone curbing along Etiwanda Avenue north of Foothill Boulevard as a unique historic resource; and WHEREAS, the city wishes to actively promote Cbe preservation and resCoratlon of the gtivanda Avenue scone curbing ROW, THEREFORE, BE IT RESOLVE, by the City Council of the City of Rancbo Cucamonga, California: All new development shall be required to restore by reconstruction Etiwanda Avenue Scone curbing in conformance with adopted City standard acceptable Co the Historic Preservation Commission. As a condition of issuance of Construction Permits within the right-of-way of gtiwanda Avenue from Foothill Boulevard north, the City xnaineer shall require a thorough Photographic documentation of the condition of curbing within the influence of the proposed construction activity. This inventory will be used Co document any damqe Co stone curbing which is caused by construction operations. Permitsea who cause damage to the stone curbinK shall be required Co make temporary repairs as directed by the City Engineer, end make payment Co the City a daEage fee equal to the current cost to reconstruct curbing to City Standard for each linear foot or portion of linear foot damaged by construction activities. Funds collected in cbis manner shall be deposited in an Etiwanda Avenue curb restoration fund to implement a program for general restoration purposes· To secure the payment of damage fees, the City Engineer shall require each permittee Co post a deposit equal Co a minimum of one-half of the length of curbinK which may be impacted by the proposed construction operations. The City ~ngineer may, at his discretion, increase this deposit if in his opinion the minimum deposit is insufficient Co adequately protect against damage. Judgment as Co the extent of damage shall be the sole discretion of the City Engineer based on the photographic evidence. Damage fees shall be withdrawn from the posted deposit and remaining funds refunded to the permittee. In Cbe event deposited funds are inadequate to cover damages, the City Engineer shall bill the permittee for the excess funds. The Council as a part of its annual Capital Improvement Program shall consider available funding for the reconstruction of logical segments of curbing which would noC otherwise be reconstructed by development activities.
