HomeMy WebLinkAbout86-195 - ResolutionsRESOLUTIO{Q NO. 86 -195 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANtEn CUCAMONGA, CALIFORNIA, PASSING ON REAPPORTIONMENT REPORT, GIVING PRELIMINARY APPROVAL, AND SETTING A TIME AND PLACE FOR PUBLIC HEARING WHEREAS, tbe CITY COUNCIL of the CITY OF RANCHO CUCAMONGA, CALIFORNIA, has previously confirmed assessments in a special assessment district pursuant to the terms and provisions of the "Municipal Improvement Act of 1913", being Division 12 of the Streets and Highways Code of the Sta~e of California, and bonds were issued to represent the costs for unpaid assessments pursuant to ~he terms and provisions of ~he "Improvement Bond Act of 1915", being Division 10 of said Code, said special assessment district known and designated as ASSESSMENT DISTRICT NO. 82-1 (hereinafter referred to as tbe "Assessment District"); and WHEREAS, subsequent thereto, certain logs and/or parcels of land upon which there are unpaid assessments bare been apportioned or divided, and this le2islative body has ordered the preparation of and has now received a "Reapportionment Report"' setting forth the sqreSation and apportionment of the unpaid installments of the original assessments, all as authorized by Part 10 of the *'Improvement Bond Act of 1915", specifically commencing with Section 8730 thereof; and WHEREAS, this legislative body is desirous to proceed to set a time and place for hearinz public testisony and/or objections upon the amended assessment, all in the manner as authorized by said Part 10. NOW, THEREFORE, IT IS BERs~Y RESOLVED AS FOLLONS: SECTION 1: That the above recitals are all true and correct. SECTION 2: That the report entitled *'Reapportionment Report"' setting forth certain segregations and apportionments of the unpaid insCallments of the original assessments for the Assessment District is hereby received, Preliminarily approved and ordered to placed on file in the Office of ~he City Clerk of the legislative body. SECTION 3: Tbst the proposed segregations and apportionments as sac forth in the Reapportionment Report, are hereby approved in the amounts se~ forth and for the respective lots or parcels as set forth in said Report. Reference is hereby msde to said Report for all particulars as it rela~es to the proposed segregations and reapportionments. SECTICE 4: NOTICE IS HEREBY GIVEN TEAT ON WEDNESDAy, THE 16TH DAY OF JULY, 1986, AT THE HOUR OF 7:30 O'CLOCK P.M., AT LIONS PARK COMMUNITY CENTER, LOCATED AT 9161 BASELINE ROAD, RANCHO CUCAMONGA, CALIFORNIA, IS TNE TIME AND PLACE FIXED FOR THE HEARING UPON TEE PROPOSED AMENDED ASSESSMENTS. ALL PERSONS INTERESTED IN THE ORIGINAL ASSESSMENT, AT THE TIME OF TEN REARING OR AT THE TIME TO WHITE THE REARING MAY BE CONTINUED, APPEAR AND PROTEST AGAINST THE AMENDED ASSESSMENT. WRITTEN OBJECTIONS TO TEE AMENDED ASSESSMENT ARE TO BE FILED WITH THE CITY CLEBi OF THE LEGISLATIVE BODY BY ANY INTERESTED PERSON AT ANY TIME NOT LATER THAN TEE TIME SET FOR TEE SEARING. SECTIres 5: That the City Clerk of the legislative body shall, ismediately following the adoption of this Resolution, cause notice to be made, pursuant to Section 6061 of the Government Code of the State of California, by baring a copy of this Resolution published in the DAILY REPORT, said publication to be sade t~o (2) times with the first publication to be completed at leas~ fifteen (15) days prior to the date set for the public hearing.
