HomeMy WebLinkAbout86-190 - ResolutionsRESOLUTICS NO. 86-190 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCA~ONGA ORDERIIeG THE WO~ IN C~NECTI~ WITH ~N~TI~ NO. 3 TO L~DS~PE ~T~CE DIS~ICT NO. ~ (TE~ VIS~ ~N~ CO~NI~) ~D ACCEPT~G THE F~ ~G~EER'S REPORT ~OR ~CT N~. 12673, 12~2 ~D 12~2-1 TH~ ~ WHEREAS, the City Council of the City of Rancho Cucasonga did on the 4th day of June, 1986, adopt its Resolution of Intention No. 86-160 to order the therein described work in connection with Annexation No. 3 co Landscape Maintenance District No. 4, which Resolution of Intention No. 86-160 was duly and legally published in the time, form and manner as required by la~, sho~n by the Affidavit of Publication of said Resolution of Intention on file in the office of the City Clerk; and HHEREA~, after the adoption thereof, notice of Cbe passage of said Resolution of Intention, headed ~Notice of Improvement", was duly and legally posted in the time, form, manner, location, and huebet as required by law, as appears from the Affidavit of Posting said notices, on file in the office of the City Clerk; and WHEREAS, after the adoption thereof, notices of the adoption of Cbe Resolution of latention were duly mailed to all persons owning real property proposed to be assessed for the improvements described in said Resolution of Intention No. 86-160, according to the names end addresses of such owners as the same appears on the last emilinS or as known to Cbe Cit~y Clerk of the City of Rancbo Cucasmnga, which said copies were duly mailed in the time, form, and manner as required by law, as appears from the Affidavit of Mailing on file in the office of the City Clerk; and WHEREAS, said City Council baring duly received considered evidence, oral and documentary, concerning the jurisdiction facts in this proceeding and concerning the necessity for Cbe coatesplated work and cbe benefits co be derived therefrom and said City Council having now acquired jurisdiction co order the proposed work. SECTIfm 1: It is hereby resolved by the City Council of the City of Rancbo Cucamangs that Cbe public interest and convenience requires the annexation to the District and the ordering of the work, and said City Council hereby orders that the work, as set fortb and described in said Resolution of Intention No. 86-160, be done and made; and SECTIm 2: Be iC further resolved Chat the report filed by the Engineer is hereby finally spproved; sad SEtTIme 3: Be it further resolved that the essessments end metbod of assessment in the lnglneer's Report are hereby approved. City C1 erk ~lige ] CITY OF RANCHO CUCAMONGA Engineer's Report for ANNEXATION NO. 3 to LANDSCAPE MAINTENANCE DISTRICT NO. 4 Terra Vista Planned Community Tract 12673, Westside Park (Parcel Map 9829), Tracts 12802-I, -2, -3, -4, -5, planrings adjacent to Tracts 12802-6 and 12802, and other street plantings. SECTION 1. Authority for Report This report is prepared in compliance with the requirements of Article 4, Chapter I, Division 15 of the Streets and Highways Code, State of California {Landscaping and Lighting Act of 1982). SECTION 2. General Description Landscape Maintenance District NO. 4 (the "District") maintains street planrings, parks, trails, and similar areas throughout the Terra Vista Planned Con~nunity. All residential developments in Terra Vista are to be annexed to the District pursuant to Ordinance No. 1gO; areas to be maintained which lie outside residential developments are also to be annexed for maintenance purposes. This Annexation No. 3 annexes to the District the following areas: eTract No. 12673 (373 multifamily dwellings) Westside Park (Parcel Map No. g82g} !ract Nos. 12802-1, 12802-2, 12802-3, 12802-4, and 12802-5 single family chwellings) m Parkway and greenway system planrings adjacent to Tract Nos. 12802-6 and 12802 · Hedtan planting in Church Street from Terra Vista Parkway to Elm Avenue All landscaped areas to be maintained in the annexed tracts are shown on the tract maps (or by separate instrument) as roadway right-of-way, dedica- tions, or easements to be granted to the City of Rancho Cucamonga. SECTION 3. Plans and Specifications The plans and specifications for the landscaping within residential tracts have been prepared by the developer and have been approved as part of the improvement plans for those tracts. The plans and specifications are in conformance with the Planning Co,mission conditions of approval. Plans and specifications for landscaped areas outside residential tracts have been separately prepared by the developer. Reference is hereby made to the subject tract maps and the assessment diagrams for the exact location of the landscaped areas. The plans and specifications by reference are hereby made a part of this report to the same extent as if said plans and specifications were attached hereto. SECTION 4. Estimated Costs No costs will be incurred for construction. All improvements will be constructed by developers. Based on historical data, contract analysis, and developed work standards, it is estimated that maintenance costs for assess- ment purposes will be as set forth below. SECTION 5. Assessment Diagram A copy of the proposed assessment diagram is attached to this report. By this reference the diagram is hereby incorporated within the text of this report. Assessment Haintenance costs for the entire 0istrtct are found to be of specific benefit to al1 developed residential property within the District in accor- dance with the following relationship: Land Use Assessment Units Single family residential dwelling Z unit Multifamily residential dwelling .S unit The City Council will hold a public hearing in June 1986, to determine the actual assessments based upon the actual costs incurred by the City during the lg85/86 fiscal year. SECTION 7. Order of Events 1. City Council adopts resolution instituting proceedings. 2. City Council adopts Resolution of Preliminary Approval of City Engineer's Report. 3. City Council adopts Resolution of Intention to Annex to District and sets public hearing dates. 4. City Council conducts public hearing, considers all testimony and deter- mines to annex to the District or abandon the proceedings. 5. Every year in May, the City Engineer files a report with the City Council. -r 6. Every year in June, the City Council conducts a public 'hearing and approves, or modifies and approves the individual assessmentS.
