A RESOLUTION OF TliE CITY COUNCIL OF T~E CITY OF RAN CliO
CUCAMONGA, CALIFORNIA, AUTHORIZING PARTICIPATION INS AN
APPEAL OF TBE LABOR SECRETARY'S DECISION TO DENY SERVICE
DELIVERY AREA DESIGNATION TO THE INLAND ENPIRE WEST CITIES
WHEREAS, the Inland Empire West cities of Chino, Montclair, Ontario,
Rancho Cucamonga, and Upland previously indicated ~heir inten~ to form a common
Service Delivery Area (SDA) to provide job ~raining and placement services to
~beir disadvantaged residents; and
WHEREAS, the California
federal Job Training ParCnership
Service Delivery Area; and
Family Economic Security Ac= (FESA) and the
Act (JTPA) authorize formation of such a
WliEREAS, tbe five Inland Empire West cities bave established a
partnership witb their appointed Private Industry Council and submitted a
L'vo-year JTPA plan to the Governor in accordance witb State and Federal law;
and
WHEREAS, the Inland Empire West cities serve a substantial par~ of a
labor marke~ area such ~bat Federal law mandates approval of tbe new SDA; and
WliEREAS, tbe Secretary of Labor has issued a final determination
denying SDA designation to the Inland Empire West cities; and
W liEREAS, Federal la~ provides for review of ~be Labor Secretary's
decision by ~be U.S. Cour~ of Appeals.
NOH, TliEREFORE, BE IT RESOLVED that cbe City of Rancbo Cucamonga
authorizes participation in an appeal of the Labor Secrecary°s decision, to be
pursued witbout delay by ~he City Attorney of ~be City of Rancho Cucamonga; and
BE IT FURTHER RESOLVED ~ba~ the City of Rancbo Cucamonga will pay its
proportionate sh~re of legal costs incurred in connection witb ~his appeal, up
co a maximum of $4,000, in ~he event ~bac such costs are not cbar~eable to the
Job Training Partnership Act funds received by Cbe City of Ontario.
