HomeMy WebLinkAbout86-158 - ResolutionsRESOLUTION NO. 86-158 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCH0 CUCAMONGA, CALIFORNIA, DECLARING ITS INTBI~TION TO ORDER THE ANNEXATION TO STREET LIGHTING MAINTBI~ANCE DISTRICT NO. 4, AN ASSESSMI~T DISTRICT: DESIGNATING SAID ANNEXATION AS ANNEXATION NO. 3 TO STREET LIGHTING MAINTENANCE DISTRICT NO. 4; 1MIRSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972 AND OFFERING A TIME AND PLACE FOR HEARING OBJECTIONS THERETO NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Rancho Cucamonga, pursuant to the provisions of the Landscaping and Lighting Act of 1972, being Division 15 of the Streets and Highways Code of the State of California, as follows: SECTION 1. Description of Work: That the public interest and convenience require and it is the intention of this City Council to form a maintenance district in the City of Rancho Cucamonga for the maintenance and operation of those street lights the boundaries of ~he proposed maintenance district described in Section 2 hereof. Said maintenance and operation includes tbe cost and supervision of any lighting and related facilities in connection with said district. SECTION 2. Location of ~ork: The foregoing described work is to be located within roadway right-of-way enumerated in the report of the City Engineer and more particularly described on maps which are on file in the office of che City Clerk, entitled "Annexation No. 3 to Street Lighting Maintenance District No. SECTION 3. Descriotlon of Assessment District: That the contemplated work, in the opinion of said tit7 Council, is of more =ban local or ordinary public benefit, and the said City Council hereby makes the expense of the said work chargeable upon a district, which said distrio: is assessed to pay ~be costs and .expenses ~hereof, and which districc is described as follows: All that certain territory of the City of Rancho Cucamonga included within the exterior boundary lines shown upon that certain "Map of Annexation No. 3 to Street Lighting Maintenance District No. 4" maps is on file in the office of the City Clerk of said City. SECTI08 ~. Report of E~ineer: The tit7 Council of said City by Resolution No. 86-157 has approved =he report of the engineer of work which report indicates ~he amount of ~he proposed assessment, the district boundary, assessmenC zones, titled "Engineer's Report, Street Lighting Maintenance District No. ~" is on file in the office of the City Clerk of said City. Reference to said repor~ is hereby made for all particulars for the amount and extent of the assessments and for ~he extent of the work. SECTION 5. Collection o[ Assessments: The assessment shall be collected at the same ~ime and in the same manner as County taxes are collected. The City Engineer shall file a report annually wi~b the City Council of said City and said Council will annually conduct a hearing upon said report at their first regular meeting in June, at which time assessments for the next fiscal year will be determined. SECTION 6. Time and Place of HearlaW: Notice is hereby given that on June 18, 198~, at the hour of 7:30 pm in the City Council Chambers at 9161 Base Line, in the City of Rencho Cucamonga, anT and all persons having any objections to the work or extent of the assessment district, may appear and show cause why said work should not be done or carried out or why said district should not be formed in accordance with this Resolution of Intention. Protests must be in writing and must contain a description of the property in which each signer thereof is interested, sufficient to identify the same, and must be Re~olucion No. 8~-158 Page 2 delivered to the City Clerk of said City prior to the time set for the hearing, and no other protests or objections will be considered. If the signer of any protest is not shown upon the last equalized assessment roll of San Bernardinn County as the owner of the propert~y described in the protests, then such protest must contain or be accompanied by written evidence that such signer is the owner of the property so described. SECTloB 7. Landscaping and LightlnS ~t of 1972: All the work herein proposed shall be done end carried through in pursuance of an act of the legislature of the State of California designated the Landscaping and Lighting Act of 1972, being Division 15 of the Streets and Highways Code of the SCats of California. SECTlOB g. Publication of Resolution of Intention: Published notice shall be made pursuant to Section 61961 of the Government Code. The Mayor shall sign this Resolution and the City Clerk shall attest to the same, and the City Clerk shall cause the same to be published 10 days before ~he date se~ fnr the hearing, at leal~ once in The Daily Ranore, a newspaper of general circulation published in the City of Ontario, California, and circulated in the City of Rancho Cucamonga, California.
