CALL TO ORDER A regular meeting of the Rancho Cucamonga City Council was held on Wednesday, September 4, 1996, in the Council Chambers of the Civic Center, located at 10500 Civic Center Drive, Rancho Cucamonga, California. The meeting was called to order at 7:03 p.m. by Mayor William J. Alexander. Present were Councilmembers: Paul Biane, James Curatalo, Rex Gutierrez, Diane Williams, and Mayor William J. Alexander. ADVERTISED PUBLIC HEARINGS G. PUBLIC HEARINGS H. CITY MANAGER'S STAFF REPORTS H1. CONSIDERATION OF DESIGNATING A VOTING REPRESENTATIVE AND AN ALTERNATE FOR THE LEAGUE OF CALIFORNIA CITIES ANNUAL MEETING Staff report presented by Jack Lam, City Manger. ACTION: The Council concurred that Williams would be the Delegate and Biane would be the Alternate. Councilmember Williams stated she would bring back any pertinent and important information to share with the entire Council. I. COUNCIL BUSINESS I1. CONSIDERATION OF CONDITIONAL USE PERMIT 95-26 - SAM'S PLACE - A six month review of compliance with Conditions of Approval for a bar located at 6620 Carnelian Street. Staff report presented by Brad Buller. City Planner. Mayor Alexander suggested that a letter be sent to Sam's Place telling them they have met all of the conditions put upon them. He felt since we always point out when they are not meeting the conditions, it was fair to let them know when they are. Councilmember.Curatalo stated he originally fought against this, but wanted to congratulate Sam on meeting all of the conditions placed on him. ACTION: Report received and filed. 12. CONSIDERATION OF A REQUEST FROM VFW POST 8680 TO BRING THE MOVING WALL-- VIETNAM VETERANS MEMORIAL TO THE CITY IN 1998 Phil DiDio, VFW Post 8680, told about how they would like to bring the wall to Rancho Cucamonga and the cermony they are planning for this. City Council Minutes September 4, 1996 Page 5 Mayor Alexancer stated he felt that the entire Council was supportive of this idea and would do whatever they could to help out in order to accomplish this. 13. REPORT BY THE PUBLIC SAFETY SUBCOMMITTEE ON SAFETY ISSUES Staff report presented by Duane Baker, Assistant to the City Manager. Councilmember Guljerrez commented on the wonderful youth in the City and that the City is trying to help keep them busy and out of trouble. He felt it was a good idea for the police to bring dogs into schools to sniff out drugs as does the City of Diamond Bar. He felt some of the areas of the City needed to be cleaned up as far as drugs are concerned. Councilmember Curatalo stated he wishes there were more neighborhood drop-in sites for the junior high and high school kids to go to. He felt the schools should let the City use their sites for programs for the teens. Mayor Alexander stated the Park and Recreation Facilities Subcommittee is addressing this issue already. J. IDENTIFICATION OF ITEMS FOR NEXT MEETING No items were identified for the next meeting. K. COMMUNICATIONS FROM THE PUBLIC K1. Pamela Stewart addressed the Council on the report on the youth information previously heard. She hoped that the City would go forward with the teen programs. She thanked the Council for what they are doing. Councilmember Willjams pointed out that a local school just threw out a local day care center through the YMCA and that they had to go find another site. She stated the task of working with the schools to use their facilities is not going to be easy. DeeDee Antonez stated there is no ice hockey rink in Rancho Cucamonga, and added her kids have to go to Ontario to play ice hockey. She wished there were facilities in our City. Councilmember Williams asked Brad Buller to provide a report on all of the activity that has gone on with applicants for ice facilities in Rancho Cucamonga so that Ms. Antonez would be aware of what has taken place. Brad Buller, City Planner, concurred. Fred Guzman felt all programs are being concentrated around the adults, but felt the programs should be focussed on the kids. He stated he has also talked to Nacho Gracia, but added the whole problem is that no one has money to build more facilities. City Council Minutes September 4, 1996 Page 6 L. Beck, Jr. Engineer ,2)j AUTHORIZE THE ADVERTISING OF THE "NOTICE INVITING BIDS" FOR THE TRAFFIC SIGNALS AND SAFETY LIGHTING AT THE INTERSECTION OF MILLIKEN AVENUE AND VICTORIA PARK LANE, TO BE FUNDED FROM COMMUNITY DEVELOPMENT TRANSPORTATION SYSTEMS DEVELOPMENT FUNDS, ACCOUNT 22-4637-9513 RECOMMENDATION: It is recommended that the City Council approve plans and specifications for the Traffic Signals and Safety Lighting at the Intersection of Milliken Avenue and Victoria Park Lane and approve the attached resolution authorizing the City Clerk to advertise the "Notice Inviting Bids". BACKGROUND/ANALYSIS: The subject project plans and specifications have been completed by staff and approved by the City Engineer. The Engineer's estimate for construction is $120,000.00. Legal advertising is scheduled for October 8, 1996, and October 15, 1996, with the Bid opening at 2:00 PM on Tuesday, November 5, 1996. Respectfully submitted, William J. RECOMMENDATION Approve a determination of "Public Convenience or Necessity (PCN)" through the adoption of the attached resolution and send a copy to the Department of Alcoholic Beverage Control. ANALYSIS A, Background: This item is the result of a request from the business owner of the Rancho Valley Golf Center. He has requested a letter from the City be sent to the Department of Alcoholic Beverage Control (ABC) stating that the issuance of an ABC license to the Rancho Valley Golf Center would serve the public's convenience and necessity. He proposes to serve beer in the club house. Requirements from the Department of ABC: The Department of ABC regulates the distribution of liquor licenses by setting limits on the types and numbers of licenses in each census tract. The limits for each type of licenses are calculated from the ratio of licenses to the population of each census tract. According to an ABC representative, there is a total of 37 active on-sale beer licenses with 5 applications pending within census tract 21.00 where the Rancho Valley Golf Center is located, thus exceeding the ABC's given limit of 18. When a census tract's limit has been reached, additional liquor licenses can be issued only if the City determines that the license would serve the public's convenience or necessity as required by Section 23958 of the Business and Professional Code. The term "public convenience and necessity" is undefined under the existing legislation. According to ABC staff, the legislation purposefully left the defining of the term to the local legislative body (City Council) in order to provide the greatest latitude, based on local conditions and determinations. The following are factors that support the requested "Public Convenience or Necessity". The serving of beer is considered as incidental to the driving range and club house and is an amenity for the players. The bulk of the land area in census tract 21.00 where the driving range is located is zoned industrial which accounts for the low limit for on-sale beer licenses. The majority of the population is located west of Haven Avenue. Rancho Valley Golf Center is not in close proximity to sensitive users such as day care facilities, schools, or churches. The site is next to the City's Adult Sports Complex, which also serves beer. However, the sports park is oriented toward Rochester Avenue and Foothill Boulevard, while the driving range is oriented toward Arrow Route. Staff did not foresee a conflict because of their close proximity to one another. Rancho Valley Golf Center is surrounded by vacant land on the north and west sides, by industrial development on the south side, and by a sports park on the east side. CONCLUSION Based on the above analysis, staff finds that the ancillary use of serving beer within the club house of a recreation facility will not have a negative impact to the surrounding uses. Staff recommends approval of the attached resolution. Temple Administrative Services Director SUBJECT: Approval of Fund Transfer and Authorize the City Manager and Director of Administrative Services to Contract for City Computer Services RECOMMENDATION Recommend the City Council approve the transfer of up to $65,000 from salary savings to contractual services and authorize the City Manager and Director of Administrative Services to contract for computer services to support the City's computer operations. BACKGROUND Currently, the City's data processing division delivers computer services to the Library and City organization. It is understaffed by 50% due to recent staff vacancies. Of the eight authorized positions including the division manager, four positions are vacant. A tremendous vacuum has been created and continuity of data processing services is critical to the operations of the City. It is critical that the City perform daily and operational business transactions. Inability to conduct urgent city business would pose an unacceptable business risk. Under the necessity to operate and maintain City computer operations, the City has retained AEF Systems. Staff's recommendation is to transfer up to $65,000 in salary savings that will accrue during the vacancy period of four to five months to contractual services. This is the period of time necessary to complete the recruitment process. With the Council's authorization the City Manager and Director of Administrative Services will negotiate and contract for computer services required to provide expertise, support daily operations, project management, and advise the City on the most effective approach to manage the current systems. Once the City has recruited, and filled the vacant positions staff will utilize the contractual work performed as the basis to review current and future technology of the City. This will assist the City in developing a vision of the next level of technological advancement for the City and its application to public services. There is no budgetry impact as a result of the fund transfer. Amateur athletes shall not receive any financial rewards or material benefits, except as permitted in the following statements: A, Amateur skateboard athletes may accept assistance in preparation for competition, such as, food and lodging, cost of transportation, pocket money to cover incidental expenses, insurance coverage, per- sonal skateboard and related eouipment, contest entry tees and any other association fees required. B, Amateurs may accept any trophies awarded for win- ning, placement or other medt achievement. C. Amateurs may accept prizes in competitions within the limits of the following requirements: 1. Maximum value no greater than the retait price of a trophy commensurable to his placement. 2. Maximum value no greater than the minimum prize money awarded to a professional skate board athlete, if in a PRO/AM contest, 3. Maximum value of $500,00 in any case. II. Amateur skateboard athletes shall not: A. Falsity the truth for purpose of participating in ama- teur skateboard competition. B. Accept comDPnsation for demonstrating their ability or the use of their name as the primary purpose of a skateboard advertisement profile, or article in any type of media. Skateboarding ability as a require merit to participate in a commercial advertisement, video, or film production does not apply to this rule. C. Amateur skateboarders may not market or advertise a signature model while claiming amateur status, To do so, immediately reclassifies the skater as a professional according to this code. III. Skateboard athletes who enter and participate in any phase of professional competition, forfeit their amateur rating and the winning of money is not a requirement. REQUIRED S ETY EQUIPMENT REQUIRED SAFETY EQUIPMENT Listed below are the minimum safety conditions and equipment require- ments as directed by Insurance Underwriters, effective 3/96. Please keep in mind that these are the minimum requirements, and that we can and will upgrade them if we feel the location and situation requires us to do so. 1 ) Barrier to restrain the spectators from entering ramp performances. 2) If a barrier of 12 ft. or greater in height exists between the spectators and ramp performances, the minimum distance between the two must be 5 feet. If a barrier of less than 12 ft. exists between the spectators and ramp performances, the minimum distance between the two must be 10 feet or more. If no barrier exists between the spectators and ramp per- formances, the minimum distance between the two must be 20 feet. 3) An individual certified in first aid must be on site at each contest responsible for providing first aid to spectators and participants. 4) See attached Addendum A.
